Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of The Wild Phase website and any wildlife safari, itinerary, accommodation, transport, guide, or related travel service arranged through us. By using the website, approving a quotation, or making a booking payment, you agree to these Terms.

1. About The Wild Phase

The Wild Phase is a wildlife travel operator based at 303, Siddhivinayak Bhakti, Plot No. 190I & 190J, Ulwe, Navi Mumbai – 410206, Maharashtra, India. We currently curate wildlife experiences including Pench and Tadoba safaris and may add other destinations.

2. Enquiries and Quotations

Website descriptions and initial communications are invitations to enquire and do not by themselves confirm a booking. A quotation is based on the information available at the time and remains subject to availability of safari permits, accommodation, vehicles, guides, transport, and other services. The validity period and inclusions stated in the quotation will apply.

3. Booking Confirmation and Payment

A booking is confirmed only after we issue written confirmation and receive the required deposit or full payment in cleared funds. Payment schedules, accepted methods, taxes, and any balance due date will be stated in the quotation or confirmation. Failure to pay by the due date may result in cancellation or release of reserved services.

4. Prices and Inclusions

Prices may vary by travel dates, nationality, permit category, group size, accommodation, vehicle type, taxes, and supplier availability. Only items expressly listed as included in the confirmed itinerary are included. Flights, insurance, meals, transfers, tips, camera fees, personal expenses, and other items are excluded unless specifically stated.

5. Safari Permits and Traveller Details

Forest permits are controlled by the relevant authorities and may be limited, non-transferable, non-refundable, or subject to identity verification. Travellers must provide complete and accurate names, ages, nationality, and identification details within the requested time. Any cost, denial, or cancellation caused by incorrect or late information may be borne by the traveller.

6. Cancellation, Amendment, and Refunds

Cancellation and amendment charges depend on the specific forest authority, hotel, transport provider, and other supplier policies applicable to your booking. The relevant schedule will be communicated in the quotation or booking confirmation. Permit fees, payment charges, and supplier amounts already committed may be non-refundable. Approved refunds will be processed after receipt from the relevant supplier and may take reasonable processing time.

7. Changes by Us or Service Providers

Wildlife travel is affected by weather, forest closures, permit rules, road conditions, safety issues, government directions, and supplier operations. We may make reasonable changes to timing, route, accommodation, vehicle, guide, or itinerary where necessary. If a material service becomes unavailable, we will try to offer a suitable alternative or the remedy available under the applicable supplier policy and law.

8. Wildlife and Safari Disclaimer

Wild animals move freely in their natural habitat. Sightings, including tiger sightings, can never be guaranteed. Photographs, past experiences, suggested zones, and guide observations do not promise any particular sighting. Travellers must follow all forest, guide, vehicle, photography, noise, waste, and safety rules.

9. Health, Fitness, and Safety

Travellers are responsible for assessing their fitness to travel and for disclosing mobility, medical, dietary, or accessibility requirements before booking. Please obtain appropriate medical advice, medicines, vaccinations, and comprehensive travel insurance. Participation in outdoor and wildlife activities involves inherent risks that cannot be completely eliminated.

10. Traveller Responsibilities

You are responsible for valid identification, permits, tickets, visas where relevant, punctual reporting, lawful conduct, safeguarding personal belongings, and compliance with instructions. We may decline or discontinue service where conduct threatens safety, wildlife, staff, local communities, property, or other travellers, subject to applicable law.

11. Third-Party Services

Hotels, forest authorities, vehicle owners, guides, payment processors, and transport operators are independent service providers. We select and coordinate providers with reasonable care, but their services are also governed by their own terms and operational control. Nothing in these Terms excludes rights or responsibilities that cannot legally be excluded.

12. Force Majeure

We are not responsible for delay, change, or failure caused by events beyond reasonable control, including natural disasters, extreme weather, fire, epidemic, strikes, civil disturbance, government action, forest closure, transport disruption, or telecommunications failure. We will provide reasonable assistance, while additional costs may remain payable by the traveller unless recoverable from a supplier or insurer.

13. Website Use and Intellectual Property

Website text, branding, layout, graphics, and original media belong to The Wild Phase or their respective licensors. You may use the website for personal travel enquiries only. You must not misuse forms, attempt unauthorized access, copy content for commercial use, introduce malicious code, or make false or fraudulent bookings.

14. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of enjoyment arising solely from absence of wildlife sightings, or acts outside our reasonable control. Any liability relating to a confirmed service will be assessed under the booking documents, applicable supplier responsibility, and applicable law. Consumer rights that cannot lawfully be limited remain unaffected.

15. Privacy

Personal information is handled as described in our Privacy Policy. Information necessary for a booking may be shared with forest authorities and relevant service providers.

16. Complaints and Dispute Resolution

Please report a service issue promptly so that we have a reasonable opportunity to assist during the trip. Formal complaints may be sent to thewildphasecare@gmail.com. We will first attempt to resolve disputes through good-faith communication. These Terms are governed by the laws of India, and courts of competent jurisdiction in Navi Mumbai, Maharashtra will have jurisdiction, subject to applicable consumer law.
